Guidance: Rule Ending D/S Temporarily Blocked
A federal judge in Massachusetts issued a preliminary injunction late yesterday that prevents the new rule ending “duration of status” (D/S) for F and J nonimmigrants from taking effect today (September 15).
While the injunction is in place, your D/S designation remains intact, and the rule has no impact on your visa status.
The injunction temporarily blocks implementation of the rule while the case continues. The lawsuit was filed by NAFSA, Presidents’ Alliance on Higher Education and Immigration, and other associations. Be aware that this order is not a final decision. Litigation will continue for days, weeks, or months. The legal process could ultimately end with the rule or some of its provisions going into effect.
